Terms of Use

1. Acceptance of Terms

By using our website, service, or application ("Service"), you agree to these Terms of Service and all applicable laws. If you do not agree, do not use our Service.

2. Service Description

We provide a traffic exchange service that allows users to earn credits ("Points") by viewing other users' websites and using those Points to send visitors to their own websites. We do not:

  • Guarantee results or payments
  • Operate as an investment or income opportunity
  • Promise specific traffic volumes or outcomes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Eligibility

  • Users must be human and at least 18 years old
  • A valid email address is required for registration
  • Users may not create multiple accounts or impersonate others
  • Users must not be located in countries where our Service is prohibited by applicable law

4. Account Termination

We may terminate, suspend, or block your access at our sole discretion, with or without notice, for any reason including:

  • Violation of these Terms
  • Fraudulent activity
  • Abuse of the Service
  • Threat of legal action
  • Use of automated tools, bots, or scripts to access the Service
  • Violation of any third-party advertising network policies

You may cancel your account at any time by contacting us. Upon cancellation, your right to use the Service ceases immediately.

5. Points System

  • Points are earned by surfing the network and can be used to send visits to your websites
  • Each point is worth a 10 second hit (a 60 second hit uses 6 points)
  • Points have no cash value and are non-transferable
  • Commission Points may be earned through referrals using your unique link
  • Points may expire after 90 days of account inactivity or at our discretion with 30 days notice
  • Results may vary and are not guaranteed to reflect in your analytics tools
  • Maximum referral commission is set at our sole discretion and may be modified

6. Subscriptions & Payments

  • Subscriptions renew automatically unless cancelled by the user
  • You are responsible for cancelling before renewal — we are not required to send reminders
  • Cancel via PayPal, your Billing page (Stripe), or our support system
  • All fees are in USD unless otherwise specified
  • Failed payments may result in suspension of services

Refund Policy (14 Days)

We offer refunds within 14 days of purchase, except for:

  • Recurring payments
  • Promotional code payments
  • Bulk/custom orders
  • Cryptocurrency payments (non-refundable)
  • Accounts abusing our service (including using more than 50% of purchased points)
  • Using different merchant accounts for the same account
  • Requests made after the 14-day window

Any threat of legal action will result in immediate account termination without refund.

Refunds are processed within 5-10 business days to the original payment method.

7. Acceptable Use Policy

You May NOT:

  • Add websites you don't own or have permission to use
  • Add content that transmits viruses, malware, or cryptojacking scripts
  • Impersonate any person or entity
  • Create multiple accounts to bypass limits
  • Use abusive, profane, or threatening language with our team — such behavior may result in a warning, suspension and/or termination
  • Use our Service to artificially inflate ad impressions, clicks, or clicks-per-second metrics
  • Use our Service in violation of any advertising network's terms of service (including but not limited to Google AdSense, Facebook Ads, and similar platforms)
  • Send traffic to pages containing deceptive content, phishing attempts, or scams
  • Use automated bots, scripts, or software to access or interact with the Service
  • Attempt to reverse engineer, decompile, or harvest any part of the Service
  • Scrape, harvest, or collect information from other users
  • Use our Service for any illegal purpose or in violation of applicable laws

You MUST:

  • Mark websites containing nudity, violence, pornography, or profanity as NSFW
  • Report any security vulnerabilities or bugs immediately
  • Ensure all websites added comply with applicable laws

Content displayed on user websites is the sole responsibility of the user who added it. We are not responsible for content falsely marked as Safe for Work.

Users under the age of 18 are prohibited from using our Site and Service.

WARNING: Using traffic exchange services may violate the terms of service of advertising platforms. You are solely responsible for understanding and complying with third-party advertising network policies. We are not liable for any consequences, including account bans or penalties, from advertising networks.

8. Your Website Content

  • You are legally responsible for all websites you add to our network
  • You represent and warrant that you own or have rights to use all content on those sites
  • You will indemnify us against all claims arising from your websites
  • You grant us a non-exclusive, royalty-free license to display your website content as necessary to provide the Service

9. Service Limitations & Disclaimers

IMPORTANT — BY USING OUR SERVICE, YOU ACKNOWLEDGE AND AGREE THAT:

Uninterrupted service availability Audio/content from user websites
All hits reflecting in your tools Ad program policies or violations
Error-free or secure operation Third-party advertising network actions
  • Results may vary due to returning visitors, VPN use, bot activity, and other factors
  • You are responsible for understanding and complying with all ad network policies
  • We may limit hits per hour based on network activity
  • We are not liable for any problems caused by using our Traffic Exchange to artificially increase ad impressions or clicks
  • Traffic quality varies and may include automated, incentivized, or non-targeted visitors

10. Intellectual Property

  • We respect others' intellectual property and expect the same from users
  • Our website content, graphics, trademarks, and materials are our property
  • Users may not reproduce, modify, or distribute our content without authorization
  • All rights not expressly granted are reserved by 10KHits LLC

11. DMCA / Copyright Infringement

Upon receipt of notice, we will take appropriate action at our sole discretion, including removing or disabling access to allegedly infringing content.

Repeat Infringement: We terminate accounts of repeat infringers in appropriate circumstances.

12. Third-Party Links and Services

  • Our Service may contain links to third-party websites or services not owned or controlled by us
  • We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services
  • You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of such third-party content, goods, or services
  • We are not responsible for the availability or reliability of external payment processors

13. Liability Limitation

YOU AGREE THAT:

  • Our Service is provided "AS IS" and "AS AVAILABLE"
  • We make no warranties, express or implied, including merchantability or fitness for a particular purpose
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid us in the past 6 months
  • We are not liable for any damages arising from third-party actions, including advertising networks
  • We are not liable for loss of data, profits, or business opportunities

Indemnification

You will indemnify, defend, and hold harmless 10KHits LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your breach of these Terms
  • Your use or misuse of the Service
  • Any claims that your content infringes third-party rights
  • Any claims related to your website or business
  • Your violation of any third-party advertising network policies
  • Any illegal activity conducted through your account

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15. Modifications to Terms

We may update these Terms at any time without notice. Changes will be effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

16. Governing Law & Disputes

Jurisdiction

These Terms are governed by the laws of California, USA, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in California.

Mandatory Arbitration

ALL disputes must be resolved through binding arbitration, not court litigation. You waive:

  • The right to a jury trial
  • The right to participate in class actions or representative proceedings
  • The right to bring claims on behalf of others

Exceptions: You may opt out of this arbitration agreement within 30 days of account creation by sending written notice to [email protected] with subject "Arbitration Opt-Out."

Arbitration Process:

  1. Notice: Send written notice of dispute to [email protected]
  2. Negotiation: Both parties attempt to resolve within 30 days
  3. Arbitration: If unresolved, submit to binding arbitration under the rules of the American Arbitration Association
  4. Filing: Send arbitration request to [email protected] with subject "Arbitration Request"

Claims may proceed in small claims court only if they qualify under that court's rules.

Any cause of action must be filed within 6 months of when the claim arises.

17. General Provisions

  • These Terms constitute the entire agreement between you and 10KHits LLC
  • If any provision is found unenforceable, the remainder remains in effect
  • Our failure to enforce any right does not waive our ability to do so later
  • You may not assign your account or rights without our written consent
  • By accessing the Site, you consent to have this Agreement provided to you in electronic form
  • Headings are for reference only and do not affect interpretation
  • These Terms apply in addition to any agreements with payment processors
